Jeremy Clarkson is in trouble again, this time facing a claim of race discrimination in the Employment Tribunal. It is perhaps now common knowledge that there is no limit on the compensation that can be awarded in a discrimination claim, however, it may come as a surprise to some employers that damages for personal injury (physical or psychiatric) can also be awarded by the Employment Tribunal. While the Tribunal will need to be careful that the claimant is not awarded for the same loss twice, there is also the potential for compensation for financial loss, injury to feelings and aggravated damages. All in all, getting it wrong could result in an expensive day out.
